3. SMS and A2P 10DLC Compliance
If you utilize our SMS services (e.g., through GoHighLevel) via A2P 10DLC (Application-to-Person 10-digit long code) messaging, you agree to the following:
a. Registration Requirement
All businesses sending SMS via A2P 10DLC must be registered with The Campaign Registry (TCR). Pronto Marketing assists clients with this process but is not liable for delays or rejections.
b. Content Responsibility
You are solely responsible for the content of your messages. You agree not to send:
Unsolicited or spam messages
Fraudulent, misleading, or illegal content
Sensitive data like financial info, health records, or login credentials
c. Opt-in and Opt-out Compliance
You must collect express written consent before sending SMS messages. You must also include clear opt-out language (e.g., "Reply STOP to unsubscribe").
d. Fines and Violations
You are responsible for any fines or penalties imposed by carriers or regulatory agencies for non-compliance with SMS rules, including A2P 10DLC violations.
4. Payments and Billing
All payments for services are due in advance unless otherwise agreed. Late payments may result in suspension of services. No refunds will be issued for completed work.
5. Intellectual Property
All content, logos, website designs, and marketing materials created by Pronto Marketing remain our intellectual property unless explicitly transferred by written agreement.
6. User Responsibilities
You agree to:
Provide accurate and updated business information
Use our services ethically and legally
Not copy, resell, or exploit our services or software without consent
7. Third-Party Tools
Our services may integrate with third-party tools (e.g., Twilio, Google, Facebook, GoHighLevel). We are not liable for issues arising from third-party platforms, including outages or data handling.
8. Termination
We reserve the right to terminate or suspend services at any time for violation of these terms, including failure to comply with SMS compliance requirements.
9. Limitation of Liability
Pronto Marketing is not liable for any direct, indirect, or incidental damages resulting from the use or inability to use our services, including lost profits or data loss.

We may update these Terms & Conditions at any time. Changes will be posted on this page with an updated effective date. Continued use of our services means you accept those changes.
